THIS AGREEMENT (hereafter “Agreement) is made and entered into by PictureThis Photobooth & Photography and the customer (hereafter “Client”) for Photobooth.
Rental Period
The rental period begins at the agreed start time and ends at the agreed end time specified in the booking confirmation. Additional charges may apply for any extension of the rental period beyond the agreed time.
Booking Confirmation
A booking is confirmed only after the required non-refundable retainer has been received and a confirmation has been issued by PictureThis Photobooth & Photography (“Company”).
The Company reserves the right to cancel or reschedule a booking due to unforeseen circumstances. If the Company cancels a booking for reasons within its reasonable control and cannot provide the contracted services, a full refund of all monies paid shall be issued.
Equipment Use
All photo booth equipment, decor, props, backdrops, printers, audio guestbooks, lighting, cables, accessories, and related equipment must be used only for their intended purpose and in accordance with Company instructions.
The Customer assumes full responsibility for all equipment from the time of delivery or pickup until returned and inspected by the Company.
Any damage, loss, theft, misuse, neglect, unauthorized modification, or intentional damage to equipment shall be the sole responsibility of the Customer. The Customer agrees to pay the full cost of repair or replacement, including shipping, labor, administrative expenses, and associated costs.
Payment and Cancellation
A non-refundable retainer is required to secure the event date. The retainer amount is determined by the selected package and may range from 25% to 50% of the total booking amount.
A booking is not considered confirmed until the required retainer has been received.
The remaining balance is due no later than one (1) day before the event date unless otherwise agreed to in writing.
All payments made to PictureThis Photobooth & Photography, including retainers, deposits, installment payments, and final payments, are non-refundable.
By reserving an event date, the Customer acknowledges that the Company removes that date from availability and may decline other booking opportunities. As a result, all payments are considered earned upon receipt and are non-refundable in the event of cancellation by the Customer for any reason.
No refunds shall be issued for cancellations, postponements, venue changes, weather-related concerns, reductions in event duration, reductions in guest attendance, dissatisfaction with attendance levels, or any other circumstance beyond the Company’s direct control.
Chargebacks and Payment Disputes
The Customer agrees to contact the Company and provide a reasonable opportunity to resolve any billing concerns before initiating a chargeback or payment dispute.
The Customer acknowledges that booking records, invoices, contracts, communications, event photographs, delivery records, and signed agreements may be used as evidence in response to any payment dispute.
Venue Requirements
The Customer is responsible for providing accurate venue information, including venue name, address, contact information, and event details.
The Customer is responsible for ensuring:
• Venue approval for Company services.
• Adequate setup space.
• Reasonable loading and unloading access.
• Adequate parking.
• Access to electrical outlets when required.
• Compliance with venue rules and restrictions.
Minimum booth setup area shall be 5 ft x 5 ft unless otherwise specified by the selected package.
If venue restrictions, parking limitations, elevators, stairs, loading delays, security requirements, or other logistical challenges delay setup, the Company shall not be responsible for any reduction in operating time.
If the Company arrives and is unable to perform services due to venue restrictions, lack of power, insufficient space, denied access, unsafe conditions, or inaccurate information provided by the Customer, the Customer shall remain responsible for the full booking amount.
Setup and Service Time
The Company may arrive prior to the event start time to complete setup.
Setup and breakdown time do not count toward the booked service time unless otherwise specified in writing.
The booked service period begins and ends at the times listed on the booking confirmation.
If the event starts late for reasons outside the Company’s control, the service period will still end at the originally scheduled time unless additional time is purchased and available.
Photo Rights and Marketing
The Customer retains ownership of photographs taken during the event.
The Company reserves the right to use photographs, videos, digital content, event footage, and media created during the event for portfolio, website, advertising, social media, marketing, educational, and promotional purposes.
Customers may opt out of marketing usage by submitting a written request before the event date.
Photos, videos, templates, galleries, and media may contain Company branding, logos, overlays, or promotional information.
Intellectual Property
All Company logos, branding, software, templates, workflows, designs, graphics, contracts, training materials, and proprietary content remain the exclusive property of the Company.
No material provided by the Company may be copied, reproduced, distributed, modified, reverse engineered, or used without prior written consent.
Customer Responsibility and Liability
The Customer is responsible for the conduct of all guests, attendees, vendors, venue staff, and participants present at the event.
Any damage caused by event participants to Company equipment or property shall be the responsibility of the Customer.
The Customer agrees to indemnify, defend, and hold harmless PictureThis Photobooth & Photography, its owners, employees, contractors, agents, and affiliates from any claims, damages, losses, liabilities, costs, attorney fees, or expenses arising from the event or the use of Company equipment and services.
Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages.
The Company’s maximum liability under this Agreement shall not exceed the total amount paid by the Customer for the booking.
The Company shall not be responsible for:
• Guest behavior.
• Venue-related issues.
• Power outages.
• Internet outages.
• Lost or damaged personal property.
• Missed photographs caused by guest participation choices.
• Failure of guests to use the equipment.
• Event delays caused by third parties.
Rental Pickups and Returns
A valid government-issued photo ID is required for all rental pickups.
The Customer assumes full responsibility for all rental equipment from pickup until return and inspection by the Company.
All equipment must be returned at the agreed return time.
Late returns may incur a fee of $200 per day or partial day.
Failure to return equipment may result in replacement charges, collection efforts, legal action, and additional recovery costs.
Replacement costs for lost, stolen, or severely damaged rental equipment may be charged up to the full replacement value of the equipment.
Termination of Services
The Company reserves the right to immediately terminate services without refund if:
• Staff are subjected to abuse, threats, harassment, discrimination, or unsafe conditions.
• Equipment is at risk of damage.
• Guests become excessively intoxicated or disruptive.
• Illegal activities occur.
• Venue conditions create a safety concern.
The Customer shall remain responsible for the full booking amount and any damages incurred.
Force Majeure
The Company shall not be liable for delays, interruptions, rescheduling, or inability to perform services due to circumstances beyond its reasonable control, including but not limited to:
• Severe weather.
• Natural disasters.
• Floods.
• Fires.
• Government restrictions.
• Venue closures.
• Power outages.
• Internet outages.
• Vehicle accidents.
• Illness or injury.
• Labor disputes.
• Acts of terrorism.
• Civil unrest.
• Equipment failure despite reasonable maintenance.
In such circumstances, the Company may, at its discretion, provide substitute equipment, substitute staff, a rescheduled service date, or another commercially reasonable solution.
Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Modification
The Company reserves the right to update or modify these Terms and Conditions. The version in effect on the date of booking shall govern that booking.
Entire Agreement
This Agreement constitutes the entire agreement between the Customer and PictureThis Photobooth & Photography and supersedes all prior discussions, negotiations, representations, and agreements.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey.
Any dispute arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located within New Jersey.
Acceptance
By booking services with PictureThis Photobooth & Photography, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions in their entirety.
